TweakTown Terms and Conditions

These Terms and Conditions govern your access to and use of the TweakTown® website, its subdomains, content, Membership accounts, community features, and other services operated by Tweak Town Pty Ltd, an Australian company (“TweakTown”, “we”, “us”, or “our”).

By accessing or using TweakTown, you agree to these Terms to the extent permitted by applicable law. If you create a Membership account, participate in community features, enter a giveaway, or purchase a paid Membership, additional terms or rules may apply. Where specific terms conflict with these general Terms, the specific terms govern the relevant service or feature.

If you do not agree to these Terms, you must not use the relevant parts of TweakTown. Where applicable law requires separate notice or affirmative consent for a material contractual, payment, or privacy change, TweakTown will provide that notice or request that consent rather than relying solely on continued use.

1. Copyright and Trademarks

Unless otherwise stated, content published on TweakTown—including text, graphics, logos, images, audio, video, databases, software, page layouts, and site design—is owned by or licensed to Tweak Town Pty Ltd and is protected by applicable copyright, trademark, and other intellectual property laws.

The TweakTown® name, logo, and associated branding are trademarks of Tweak Town Pty Ltd. You may not use, reproduce, imitate, or represent yourself as being associated with TweakTown without prior written permission.

Content owned by third parties remains the property of its respective owner and may be used by TweakTown under licence, permission, fair dealing, or another lawful basis. You may not reproduce, republish, distribute, publicly display, modify, scrape, or commercially exploit TweakTown content unless:

• the use is expressly permitted by law;
• the content includes a licence allowing that use; or
• Tweak Town Pty Ltd has provided prior written permission.

2. Use of Content by AI Systems and Automated Services

TweakTown content, including text, images, videos, data, and metadata, is protected under applicable intellectual property laws. Use of TweakTown content by artificial intelligence systems, machine-learning models, automated agents, or bots for model training, fine-tuning, dataset creation, model evaluation, or the development of AI products is prohibited unless the use occurs through a licensed or otherwise expressly approved mechanism provided or authorised by Tweak Town Pty Ltd.

Retrieval-augmented generation (RAG), grounding, and similar real-time reference systems may access TweakTown content only where that access:

• complies with TweakTown’s robots.txt rules and other technical access controls;
• does not use the content for model training or fine-tuning;
• provides clear attribution to TweakTown;
• includes a prominent, working link to the original TweakTown page; and
• does not reproduce or substitute for a material part of the original content.

Public search engines and search services may index and reference TweakTown content for search-result links and excerpts where they comply with TweakTown’s robots.txt rules and other applicable access conditions. AI-generated search summaries may reference TweakTown content where clear attribution and a prominent clickable link to the original page are provided.

Our robots.txt rules, crawler controls, and approved licensing mechanisms form part of the conditions governing automated access to TweakTown. We may restrict, revoke, rate-limit, block, or require licensing for automated access at any time.

3. Editorial Content, Accuracy, and Third-Party Information

TweakTown publishes news, reviews, guides, commentary, and other editorial content for general informational purposes. We make reasonable efforts to publish accurate and current information, but technology, prices, specifications, availability, software, services, and other circumstances can change quickly.

To the maximum extent permitted by law, TweakTown does not guarantee that all editorial content will always be complete, current, accurate, error-free, or suitable for every purpose. We may correct, update, withdraw, or amend content without notice.

Opinions expressed by individual staff members, contributors, freelance writers, interviewees, community members, or other third parties are their own and do not necessarily represent the views of Tweak Town Pty Ltd.

TweakTown content is not professional legal, financial, medical, tax, safety, or other regulated advice. Technical guides and recommendations may not be suitable for every system, configuration, or circumstance. You should assess your own situation, follow relevant manufacturer instructions, maintain appropriate backups, and seek qualified professional advice where appropriate.

TweakTown may link to or reference third-party websites, products, downloads, software, services, prices, or information. Those third parties are responsible for their own content, availability, security, terms, and privacy practices. A link or reference does not mean that TweakTown controls or endorses every aspect of the third-party service.

4. Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, remedy, or liability that cannot lawfully be excluded, restricted, or modified.

If the Australian Consumer Law applies to you, goods and services supplied by TweakTown come with consumer guarantees that cannot be excluded. You may also have mandatory consumer rights under the laws of your country, state, province, or territory of residence. These Terms do not remove those rights where they cannot lawfully be excluded.

Any exclusion, disclaimer, limitation, or qualification in these Terms applies only to the maximum extent permitted by applicable law.

5. Limitation of Liability

Subject to Section 4 and to the maximum extent permitted by law, TweakTown is not liable for indirect or consequential loss that was not reasonably foreseeable when you used the relevant content or entered into the relevant contract with us.

When using free editorial or community features, you remain responsible for deciding whether to rely on content, follow a guide, install software, change a configuration, visit a third-party website, or act on a recommendation. TweakTown is not responsible for loss caused solely by:

• your failure to follow relevant instructions or warnings;
• your use of content for a purpose for which it was not intended;
• unauthorised or unsupported modification of hardware or software;
• a third-party product, service, website, download, or action outside TweakTown’s reasonable control; or
• information that was accurate when published but later became outdated due to events outside TweakTown’s reasonable control.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, personal injury or death caused by negligence, or any other liability that cannot lawfully be excluded or limited.

Liability and remedies relating specifically to a paid Membership, merchandise benefit, giveaway, or other paid or promotional service are also governed by the applicable specific terms and by any non-excludable statutory rights.

6. User-Generated Content and Community Participation

User-generated content includes comments, replies, reactions, display names, avatars, custom titles, profile information, mentions, public profile content, and other material submitted or displayed through TweakTown community features (“Member Content”).

You retain ownership of any intellectual property rights you hold in your Member Content. TweakTown does not claim ownership of Member Content merely because it is submitted to the service.

By submitting Member Content, you grant Tweak Town Pty Ltd a non-exclusive, worldwide, royalty-free licence to host, store, back up, cache, reproduce, technically format, display, moderate, and distribute that Member Content through TweakTown properties as reasonably necessary to operate, secure, maintain, and preserve the service.

This licence permits TweakTown’s hosting, security, email, content-delivery, moderation, and other technical service providers to process Member Content only as reasonably necessary to provide services to TweakTown. It does not grant TweakTown a general right to sell your Member Content as merchandise, use it as an unrelated advertising endorsement, or commercially exploit it outside the operation and preservation of TweakTown.

The licence continues only for as long as reasonably necessary to:

• display and operate the relevant community feature;
• maintain legitimate backups, caches, moderation records, and security records;
• preserve discussion threads and historical contributions in an anonymised form;
• comply with legal obligations or resolve disputes; or
• retain material that may lawfully remain after account deletion under these Terms and the Privacy Policy.

You are responsible for your Member Content and must have the rights and permissions necessary to submit it. You must not submit content that is unlawful, defamatory, threatening, harassing, deceptive, infringing, invasive of privacy, malicious, or otherwise prohibited by these Terms or the Community Guidelines.

Member Content represents the views of the member who submitted it. TweakTown does not necessarily endorse, verify, or agree with Member Content.

We may review, restrict, edit, format, hide, reject, remove, preserve, or report Member Content where reasonably necessary to:

• enforce these Terms or the Community Guidelines;
• protect members, staff, third parties, or TweakTown systems;
• respond to legal complaints or obligations;
• prevent spam, fraud, manipulation, impersonation, or security abuse; or
• operate and maintain community features.

We are not required to pre-screen all Member Content, and moderation does not make TweakTown the author or endorser of that content.

7. Product Reviews, Sponsorships, and Affiliate Links

TweakTown staff, contributors, and editors may receive products, hardware, software, travel, access, or other materials from manufacturers, brands, public-relations agencies, or other organisations for evaluation and editorial coverage. Products supplied for review may sometimes be retained for long-term testing, comparison, reference, or archival purposes.

Receipt of a review sample does not guarantee coverage, favourable coverage, a particular rating, or editorial approval. Reviews and editorial opinions reflect the honest assessment of the relevant writer or reviewer based on their testing, research, experience, and editorial judgment.

Content produced under a paid arrangement is identified as sponsored, promoted, branded, or otherwise commercially supported where appropriate. Sponsored content is distinct from independent editorial reviews and does not guarantee favourable editorial treatment.

TweakTown participates in affiliate marketing programs, including the Amazon Services LLC Associates Program and programs operated by other retailers or service providers. TweakTown may earn a commission when a reader follows an affiliate link and completes a qualifying transaction, generally at no additional cost to the reader.

Affiliate relationships support TweakTown’s operations but do not determine editorial conclusions, product ratings, or recommendations.

8. TweakTown Membership Accounts

8.1 Free Membership eligibility. You must be at least 13 years old to create or use a free TweakTown Membership account. By completing registration, you confirm that you meet this requirement and that the information you provide is accurate.

8.2 Paid Membership eligibility. You must be at least 18 years old to purchase or hold a paid Supporter or Premium Membership. Paid plans are governed by these Terms, including Sections 8.14 to 8.18, together with the pricing, renewal, cancellation, refund, benefit, and other specific disclosures shown on the Membership page, during checkout, and in My Account.

8.3 Registration and sign-in. TweakTown uses passwordless sign-in. You may sign in using a one-time email link, a six-digit code sent to your email address, or an approved third-party identity service such as Google. You are responsible for maintaining control of the email address and third-party account used to access your Membership.

8.4 Account responsibility. You are responsible for activity carried out through your account unless the activity results from a security failure caused by TweakTown. You must not sell, transfer, share, or allow another person to misuse your Membership account.

8.5 Display names. You may choose an optional public display name. If you do not choose one, TweakTown may display your first name and last initial. Display names must comply with the Community Guidelines and must not be misleading, offensive, reserved, or used to impersonate another person, brand, moderator, editor, or TweakTown staff member.

TweakTown may reclaim, reset, or restrict a display name that breaches these requirements. Name and display-name changes may be subject to reasonable frequency limits, including the existing 30-day change limit.

8.6 Paid badges and custom titles. Paid-tier badges and indicators identify the member’s TweakTown Membership tier only. They do not represent employment, editorial authority, moderator status, identity verification, or endorsement by TweakTown. Premium custom titles are subject to review and must not imply official authority or impersonate another person or organisation.

8.7 Profile pictures. Profile pictures must comply with the Community Guidelines. TweakTown may import a profile picture from Google or Gravatar where described in the Privacy Policy and may review, reject, remove, resize, crop, or convert profile pictures for security, presentation, and moderation purposes.

8.8 Community features. Membership may include public comments, replies, reactions, mentions, reputation, badges, saved content, notifications, giveaways, profile pages, custom titles, and other features introduced over time. Use of those features is governed by these Terms and the Community Guidelines.

8.9 Newsletter giveaways. TweakTown newsletter giveaways are free to enter and no purchase is necessary. Entry may require a free TweakTown Membership account registered to the same email address as a confirmed TweakTown daily newsletter subscription. Entrants must meet any age, location, entry-period, and other eligibility requirements stated in the relevant giveaway announcement or entry page. TweakTown staff, TweakAdmin accounts, employees or contractors directly involved in administering the giveaway, and any other excluded persons are not eligible. Unless stated otherwise, only one completed entry per person and email address is permitted for each giveaway.

Winners are selected at random from eligible entries after the giveaway closes and are contacted using the email address associated with their entry. Entrants are responsible for providing accurate information and monitoring that email address, including its spam or junk folder. If a selected winner cannot be contacted, does not respond within the period stated in the winner notification, cannot verify eligibility, or declines the prize, TweakTown may select an alternate winner.

Prizes are not transferable or redeemable for cash unless TweakTown agrees otherwise. If an advertised prize becomes unavailable for reasons outside TweakTown’s reasonable control, TweakTown may provide a substantially equivalent replacement where permitted by law. TweakTown or the relevant prize provider may request information reasonably necessary to verify the winner and deliver the prize. Delivery times may vary, and international winners are responsible for customs duties, import taxes, local charges, or restrictions imposed in their country unless the giveaway announcement states otherwise.

Where partner email sharing is enabled for a sponsored giveaway, entry also requires the separate consent shown before entry. That consent allows TweakTown to share the entrant’s email address with the named prize partner for the purposes described in the consent notice and Privacy Policy. If partner email sharing is not enabled, no partner-marketing consent is required to enter.

By entering a giveaway, you agree to this Section 8.9 and the information shown in the relevant giveaway announcement or entry flow. TweakTown may reject or disqualify automated, duplicate, fraudulent, incomplete, manipulated, or otherwise invalid entries, and may disqualify an entrant who breaches these Terms or interferes with the giveaway. TweakTown may suspend, modify, postpone, or cancel a giveaway where reasonably necessary because of fraud, technical failure, legal requirements, prize unavailability, or circumstances outside its reasonable control. Nothing in this section excludes any consumer right or remedy that cannot lawfully be excluded.

8.10 Security and transactional communications. We may send emails or other notices that are reasonably necessary to operate and secure your account, including sign-in messages, security alerts, account changes, moderation notices, billing notices, and deletion or restoration notices. Marketing and newsletter communications are separate and subject to your applicable preferences and consent choices.

8.11 Third-party sign-in. If you sign in using Google or another third-party identity provider, your use of that provider is also governed by its own terms and privacy policy. TweakTown requests only the information reasonably necessary to create, verify, and secure your account and does not access Gmail, Drive, Contacts, or other unrelated Google content.

8.12 Legacy comments. TweakTown may securely link comments from a legacy commenting system to a Membership account where the relevant email addresses match, as described in the Privacy Policy. Historical comments may then appear under the member’s current display name and avatar unless the account or contribution has been anonymised.

8.13 Comment of the Month. TweakTown may select one Comment of the Month winner for each calendar month. Comment of the Month is a judged community award and is not a random draw. TweakTown may decide not to award a prize for a month if no eligible comment or reply is considered suitable.

Eligibility. To be eligible, a member must:

• be at least 18 years old;
• hold an active paid Supporter or Premium Membership when the comment or reply is posted;
• continue to hold active paid Membership access when the winner is selected;
• have posted an approved and publicly visible comment or reply during the relevant calendar month; and
• comply with these Terms and the Community Guidelines.

A paid Membership with cancellation scheduled remains active and eligible until its paid access period ends. TweakTown staff, TweakAdmin accounts, and anyone involved in selecting or administering the award are not eligible.

Comment of the Month is open worldwide, subject to applicable law. Calendar months and comment timestamps are determined using TweakTown’s server time in the America/Chicago time zone, including applicable daylight-saving time.

Selection. TweakTown selects the winner using editorial judgment. Factors may include originality, insight, usefulness, relevance to the discussion, clarity, and respectful participation. Reactions, likes, dislikes, reputation scores, or popularity may be considered but do not determine the winner.

Both comments and replies may qualify. A comment or reply is not eligible, or may cease to be eligible before payment, if it:

• is deleted, anonymised, hidden, rejected, or removed;
• breaches these Terms or the Community Guidelines;
• contains spam, plagiarism, manipulation, fraud, or misleading information;
• was posted using an ineligible, suspended, banned, or fraudulent account; or
• cannot be verified as an eligible public contribution.

TweakTown may select an alternate winner if the original selection becomes ineligible before payment. Previous winners remain eligible to win again in a later month; there is no winner cooldown.

Prize. The prize is determined by the winner’s active paid Membership tier when the winner is selected:

• Supporter: USD $100; or
• Premium: USD $200.

If a member changes tiers before selection, the prize corresponding to the member’s active tier at the time of selection applies.

Winner contact and verification. TweakTown will contact the selected winner using the verified email address associated with the Membership account. The selected winner must respond within 14 days and provide information reasonably required to confirm:

• their identity and Membership account;
• that they are at least 18 years old;
• their country of residence;
• their continuing eligibility; and
• their preferred available payment method and payment instructions.

If the selected winner does not respond within 14 days, cannot verify eligibility, declines the prize, or does not provide usable payment information, the prize may be forfeited and TweakTown may select an alternate winner.

Payment. Payment is completed manually by TweakTown. Available payment methods may include PayPal or bank transfer where practical. TweakTown does not provide an automated payout account, payment portal, or stored payment-details service.

Payment instructions supplied by the winner are not stored in the TweakTown Membership system or on the TweakTown website server. The email containing the winner’s payment instructions will be manually deleted after successful payment, subject to any legal obligation requiring limited transaction evidence to be retained.

TweakTown will initiate payment for the applicable stated prize amount. The winner is responsible for any PayPal, bank, intermediary-bank, receiving, withdrawal, foreign-exchange, currency-conversion, or other transfer fees. TweakTown will not increase or reimburse the prize to cover those fees.

The winner is responsible for determining and meeting any personal tax, reporting, exchange-control, or similar obligation arising from receipt of the prize.

Public announcement. TweakTown may publicly announce the winner’s display name, paid Membership tier, winning comment or reply, and the article or page on which it appeared. TweakTown will not publish the winner’s private email address, payment details, home address, or other non-public account information.

Administration. TweakTown may investigate eligibility, correct an administrative error, disqualify fraudulent or manipulated participation, or withhold payment while a genuine eligibility or Community Guidelines issue is reviewed. TweakTown’s selection decision is final, subject to any right or remedy that cannot lawfully be excluded.

8.14 Paid Membership plans and benefits. Supporter and Premium Memberships are personal, non-transferable paid plans. The benefits included with each plan are those described on the Membership page and in My Account at the time of purchase, subject to these Terms and any specific eligibility conditions shown for a benefit.

Paid benefits may include ad-free access on eligible TweakTown pages, paid-tier badges, paid member titles, private community access, Comment of the Month eligibility, and other benefits described for the relevant tier. Premium benefits include Weekly Early Access as described below and may also include an approved custom title and, for a qualifying Premium Annual purchase, the welcome pack described in Section 8.17.

Weekly Early Access. Premium Membership includes access to one selected TweakTown review, article, or guide each week, made available to eligible Premium members 24 hours before its public release. TweakTown determines which content is selected. If a selected item is delayed, TweakTown may also delay its public release so that the 24-hour Early Access period can continue. If a selected item is withdrawn or cannot be published for editorial, legal, security, technical, or operational reasons, TweakTown may substitute another item. Early Access is available only while Premium Membership benefits are active and does not change the content-use restrictions in Sections 1 and 2.

Ad-free access removes ordinary third-party advertising placements and related advertising scripts from eligible pages while paid benefits are active. It does not remove first-party notices, house promotions, affiliate disclosures, sponsorship disclosures, or editorial content that is itself sponsored or commercially supported.

A feature described as planned, future, coming soon, in development, or not yet available does not become an active paid benefit until TweakTown launches it. Any estimated launch timing is indicative only unless TweakTown expressly states otherwise.

8.15 Pricing, billing, renewals, plan changes, cancellation, and refunds. All listed paid Membership prices are in United States dollars (USD). Applicable taxes may be added at checkout. Your bank, card issuer, or payment provider may apply currency-conversion, international-transaction, or other fees. TweakTown does not represent displayed USD prices as local-currency billing.

Paid Membership is billed through Stripe. Card details are entered with and handled by Stripe; TweakTown does not store your full card number or card security code. TweakTown retains or receives the billing and subscription records reasonably required to operate the Membership, confirm payment status, administer access, prevent fraud, maintain financial and audit records, and provide support.

Automatic renewal. Paid Membership renews automatically at the end of each monthly or annual billing interval until you cancel. You authorise Stripe and TweakTown to charge the applicable renewal amount, plus any applicable tax, using the payment method associated with your subscription.

You may cancel through My Account or the Stripe Customer Portal. Cancellation stops the next renewal. It does not normally end paid access immediately: paid benefits continue until the end of the current paid period, after which the account returns to the free Membership tier. Mid-period cancellation is not prorated.

If a renewal payment fails, TweakTown may provide a temporary grace period, currently seven days, during which some or all paid benefits may continue while payment is retried or updated. If payment is not recovered within the applicable grace period, paid benefits may end and the account may return to the free Membership tier.

A Supporter-to-Premium upgrade may take effect immediately and may result in a prorated charge or credit calculated by Stripe. A Premium-to-Supporter downgrade is scheduled for the next renewal and does not reduce Premium benefits during the current paid period. The effective timing and any amount due are shown before you confirm the change.

Subscription payments are non-refundable for change of mind, non-use, dissatisfaction after purchase, or failure to cancel before renewal, except where a refund, replacement, credit, re-performance, cancellation right, or other remedy is required under applicable law. TweakTown does not ordinarily provide voluntary prorated refunds for mid-period cancellations or scheduled downgrades.

TweakTown may manually correct a duplicate charge, billing error, confirmed fraud, or another exceptional case, or provide a discretionary goodwill remedy. Any such action does not create an ongoing entitlement or alter the general refund policy.

8.16 Founding Member. Paid members whose first qualifying paid Membership begins during the founding window receive a permanent Founding Member badge that is separate from their Supporter or Premium tier badge. The founding window runs for 12 months from the public Membership launch date.

The Founding Member badge remains associated with the member’s account if the paid tier later changes or ends. It may be removed if the account is deleted or where the award resulted from fraud, abuse, ineligibility, or an administrative or technical error. The badge is a Membership recognition marker only and does not represent employment, editorial authority, identity verification, or endorsement by TweakTown.

8.17 Premium Annual welcome pack. A qualifying Premium Annual Membership includes one welcome pack per member lifetime: one oversized TweakTown mouse pad and one TweakTown T-shirt. The welcome pack is linked to the first qualifying Premium Annual purchase. Renewals, later annual purchases, plan changes, replacement accounts, or repeated claims do not create another welcome pack unless TweakTown expressly agrees or applicable law requires a remedy.

Welcome-pack claims and fulfilment are subject to availability, destination restrictions, accurate claim details, and the claim process shown in My Account. If stock is temporarily unavailable, an eligible claim may be placed in an awaiting-stock state until fulfilment can proceed. TweakTown does not guarantee a particular restock, dispatch, or delivery date.

Worldwide welcome-pack shipping is offered from Australia through Australia Post or another selected carrier, subject to current legal, carrier, sanctions, service, and destination restrictions. As at the date of these Terms, welcome-pack shipping is unavailable to Denmark, Iran, Iraq, Kiribati, Kosovo, Lebanon, Russia, and Sudan. Available and excluded destinations may change where reasonably necessary because of law, sanctions, carrier availability, safety, or practical delivery limitations.

International recipients are responsible for customs duties, import taxes, postal handling fees, customs-clearance charges, or other destination-country charges. These charges are not included with the welcome pack and are not reimbursed by TweakTown.

TweakTown aims to prepare and dispatch a welcome pack within 10 business days after the 48-hour correction window closes. This is a target, not a guaranteed dispatch date, and is separate from carrier transit time. The correction window begins on the first successful submission of claim details. After that window, address or size changes are manual and may not be possible if fulfilment has progressed. You are responsible for checking the recipient name, delivery address, telephone number, country, and T-shirt size you submit.

If a parcel is returned because of an incorrect or incomplete address, refusal, non-collection, or unpaid import charges, reshipping is manual and is not automatically free. You may be required to pay actual return, handling, and reshipping costs, subject to recovery of the parcel and stock availability. TweakTown does not guarantee that every returned parcel can be reshipped.

Cases caused by a TweakTown addressing error or confirmed carrier loss or damage are reviewed separately and may receive an appropriate no-cost remedy, subject to applicable law and stock availability.

There is no cash alternative for an unclaimed welcome pack except where required by law. Normal cancellation does not refund the annual Membership payment or require return of a shipped welcome pack, and change-of-mind returns are not offered. Faulty, damaged, or misdescribed items remain subject to applicable consumer guarantees and other non-excludable legal rights.

8.18 Private Discord community access. Eligible paid members may request access to a private TweakTown community hosted on Discord. Access is optional, is currently administered manually, and requires the member to provide an accurate Discord username or handle. Discord access may be added, updated, or removed when eligibility changes, when the member requests a change, when the Membership or account ends, or where access is restricted under these Terms, the Community Guidelines, or applicable Discord rules.

Discord is an independent third-party service. Your use of Discord is also governed by Discord’s own terms and privacy policy. TweakTown does not control Discord’s independent service, availability, security, moderation, or processing of information.

9. Acceptable Use, Suspension, and Account Termination

You must not use TweakTown to:

• harass, threaten, abuse, discriminate against, or impersonate another person;
• post unlawful, infringing, deceptive, defamatory, sexually explicit, or gratuitously violent content;
• share another person’s private or confidential information without authority;
• send spam, scams, undisclosed advertising, or abusive promotional content;
• manipulate reactions, reputation, votes, giveaways, account limits, or community systems;
• probe, disrupt, overload, bypass, reverse engineer, or misuse TweakTown’s security or technical systems;
• operate unauthorised bots, automated accounts, scrapers, or bulk-posting tools; or
• use TweakTown in a way that violates applicable law, these Terms, or the Community Guidelines.

TweakTown may warn, restrict, suspend, ban, or remove an account or particular feature where reasonably necessary to address a breach, security threat, fraud concern, legal obligation, or risk to members, staff, third parties, or TweakTown systems.

Where appropriate, we may notify you of an enforcement action and provide an opportunity to contact support. Serious, fraudulent, dangerous, or repeated breaches may result in immediate or permanent action.

Account moderation or termination does not remove any statutory right or accrued remedy that cannot lawfully be excluded. Paid subscription cancellation, paid-through access, refunds, and statutory remedies are governed by Section 8 of these Terms, the specific disclosures shown before purchase or in My Account, and applicable law.

10. Account Deletion

You may request deletion of your Membership account through My Account where available.

For a free account with no continuing paid billing arrangement, deletion generally enters a 14-day restoration period before personal Membership data is anonymised in accordance with the Privacy Policy.

If your account has a continuing paid Membership, TweakTown may first stop future renewal and keep the account accessible through the applicable paid-through or grace date. Final account deletion will be scheduled for no earlier than the later of:

• the end of the applicable restoration period; and
• the end of any paid-through or benefit-access period.

Restoring or cancelling an account-deletion request does not automatically reverse a separately scheduled subscription cancellation. Billing and subscription matters remain governed by Section 8 of these Terms, the specific disclosures shown before purchase or in My Account, and the relevant account controls.

After final deletion, identifying Membership data is removed or anonymised subject to legal, security, financial, dispute, and audit retention requirements. Historical community contributions may remain in anonymised form so that discussions and reply threads are not broken.

11. Changes to TweakTown and These Terms

TweakTown may introduce, modify, suspend, or discontinue editorial sections, free features, technical systems, layouts, or community functionality as the service develops. We may also make changes that are reasonably necessary for security, legal compliance, abuse prevention, technical operation, or compatibility with third-party services.

Where we make a material change to these Terms, we will provide reasonable notice through the website, email, account messaging, or another appropriate method before the change takes effect where practicable.

Material changes to paid Membership pricing, renewal terms, or paid benefits are governed by these Terms, the specific disclosures shown before purchase or in My Account, and any applicable legal notice or consent requirements.

Where applicable law requires affirmative consent to a material contractual, payment, or privacy change, TweakTown will request that consent. Continued use will not be treated as universal affirmative acceptance where separate consent is legally required.

12. Paid Membership and Additional Terms

Paid Supporter and Premium Membership plans are governed by these Terms, including the paid Membership provisions in Section 8, and by the pricing, renewal, cancellation, refund, benefit, and other specific disclosures shown on the Membership page, during checkout, or in My Account. Those disclosures form part of the agreement for the relevant purchase or feature.

Specific rules may also apply to Weekly Early Access, welcome-pack benefits, giveaways, Comment of the Month, private community access, Founding Member recognition, promotional programs, and other optional features. Where a specific disclosure or feature rule conflicts with a general provision of these Terms, the more specific provision governs that service or feature to the extent permitted by law.

13. Privacy

TweakTown’s Privacy Policy explains how we collect, use, disclose, secure, retain, and provide choices regarding personal information. It applies alongside these Terms.

The Privacy Policy appears on the TweakTown legal page and includes additional information relating to Membership accounts, community participation, privacy preferences, newsletters, and giveaways.

14. Governing Law and Disputes

These Terms are governed by the laws of Queensland and the Commonwealth of Australia.

The courts of Queensland and the applicable courts of the Commonwealth of Australia have non-exclusive jurisdiction in relation to disputes arising from these Terms.

Nothing in this section deprives a consumer of:

• mandatory consumer protections that cannot lawfully be excluded in their country, state, province, or territory of residence; or
• access to a court, tribunal, regulator, complaint process, or remedy that cannot lawfully be excluded.

15. Events Outside Our Reasonable Control

TweakTown is not responsible for a failure or delay caused by events outside its reasonable control, including natural disasters, severe weather, fire, flood, war, civil disturbance, industrial action, widespread internet or power failures, governmental action, major supplier failure, cyber incidents, or failure of third-party infrastructure.

Where such an event affects a service, TweakTown will take reasonable steps to reduce disruption and restore the affected service. This section does not exclude any statutory right or obligation that cannot lawfully be excluded.

16. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A failure or delay by TweakTown in enforcing a provision does not waive the right to enforce it later.

These general Terms, together with the Privacy Policy, Community Guidelines, and any applicable specific terms, form the agreement governing your use of the relevant TweakTown service or feature.

Newsletter Giveaway Privacy and Prize Partner Email Marketing

This section explains how TweakTown collects, uses, discloses, transfers, and retains personal information in connection with newsletter giveaways. The entry, eligibility, draw, winner, and prize rules are set out in Section 8.9 of the TweakTown Terms and Conditions.

Subscribing to the TweakTown newsletter or creating a Membership account does not, by itself, share your email address with a prize partner.

For selected sponsored giveaways, TweakTown may require your consent to share your email address with the prize partner named before entry. Where this applies, the consent notice will identify the partner and explain that the partner may use your email address for its own marketing communications about its products, services, promotions, or related activities.

Partner marketing consent is optional. However, where partner email sharing is a condition of a particular sponsored giveaway, you cannot enter that giveaway without providing the required consent. You may skip that giveaway and remain subscribed to the TweakTown newsletter.

If you provide consent, TweakTown may include your email address in the entrant list supplied to the named prize partner. The partner’s marketing communications are separate from the TweakTown newsletter and are governed by the partner’s own privacy policy, marketing practices, and unsubscribe process.

The named partner is responsible for the marketing communications it sends after receiving your email address. To stop those communications, use the unsubscribe method provided by the partner or contact the partner directly. Unsubscribing from the TweakTown newsletter does not automatically unsubscribe you from communications sent independently by a prize partner.

When you consent to partner email sharing, TweakTown records information needed to demonstrate what you agreed to. This may include:

• the date and time of consent;
• the partner name or names displayed before entry;
• the version or content hash of the consent disclosure;
• the giveaway connected to the consent;
• your IP address and related technical audit information; and
• the date on which entrant information was supplied to the partner, where applicable.

You may contact support@tweaktown.com to withdraw your permission before TweakTown has supplied the entrant list to the named partner. Once information has already been lawfully disclosed, withdrawal does not reverse that disclosure or automatically delete the partner’s copy. You may contact the partner directly to exercise any applicable access, correction, deletion, objection, or marketing opt-out rights.

A prize partner may be located outside Australia, including in the United States, the United Kingdom, Taiwan, or the European Economic Area. If you enter a partner-sharing giveaway, your email address may be transferred to and processed in the country where the named partner operates. The partner’s privacy laws and practices may differ from those in Australia.

If you win a giveaway, TweakTown may separately collect your name, delivery address, telephone number, and other information reasonably required to verify eligibility and deliver the prize. TweakTown may provide the required fulfilment information to the sponsor, distributor, courier, or other company responsible for delivering the prize. Winner fulfilment disclosure is separate from entrant-list marketing consent.

Giveaway entry, consent, winner, and fulfilment information may be retained for as long as reasonably necessary to administer the giveaway, demonstrate consent and eligibility, prevent duplicate or fraudulent entries, resolve disputes, and meet legal, tax, accounting, or audit obligations. Information that is no longer required is deleted or de-identified where appropriate.

California residents: Depending on the giveaway and applicable law, disclosing an entrant’s email address to a prize partner for that partner’s own marketing may be treated as a sale or sharing of personal information. Where partner email sharing is enabled, TweakTown makes that disclosure only after the entrant provides the consent presented for that giveaway. California residents may also use the Privacy control on the website to exercise applicable privacy choices.

TweakTown Membership

The following supplements our Privacy Policy and explains how TweakTown handles personal information when you create or use a free or paid TweakTown Membership account.

What we collect for TweakTown Membership

• Identity and profile: your first name, last name, public display name, approved profile picture, and, where applicable, a Membership badge or approved custom title.
• Contact: your verified email address.
• Authentication: one-time sign-in codes and magic-link tokens, which are stored only as secure hashes. If you use Google sign-in, we process your Google account’s stable subject identifier, verified email address, and basic profile details needed for sign-in. We do not store your Google password or access Gmail, Drive, Contacts, or other unrelated Google content.
• Profile pictures: images you upload, or images automatically imported from your Google account or Gravatar where available. Imported and uploaded images may be resized, cropped, converted to WebP, and stripped of embedded metadata. You may replace or remove your profile picture in My Account. The original source image is discarded after processing.
• Sessions and devices: a hashed session identifier, IP address, approximate city and country derived from that IP (via Cloudflare), approximate browser or device information, and sign-in, activity, expiry, and revocation timestamps. Approximate city and country may appear on your sessions list in My Account and in security emails. They are not a verified home or billing address and may be missing or incorrect, including when you use a VPN.
• Security and audit records: records of sign-ins, new-device sign-ins, sign-in-method changes, email changes, sign-out-all actions, suspensions, moderation actions, account deletion or restoration, and other security-relevant or administrative events. These records may include an IP address, approximate city and country derived from that IP, user agent, timestamps, and the administrator responsible for an action.
• Consent and policy records: the policies and versions you accepted, your age confirmation, newsletter choice, optional giveaway consent, and associated timestamps and audit information.
• Preferences: notification, newsletter, display, community, and other account preferences.
• Membership and entitlement records: where paid Membership is available, your plan or tier, billing interval, entitlement status, access period, renewal, cancellation, grace, Founding Member, and benefit-eligibility records needed to determine which Membership features you may access.
• Billing and subscription records: Stripe customer, subscription, schedule, price, checkout-session, invoice, payment-status, tax, refund, dispute, and billing-portal identifiers or records; the amount and currency charged; renewal and cancellation information; and related transaction, reconciliation, audit, and support records. Card details are entered directly with Stripe and are not stored by TweakTown.
• Welcome-pack fulfilment: if you claim a Premium Annual welcome pack, the recipient name, delivery address, telephone number, country, T-shirt size, claim and correction timestamps, inventory or stock status, fulfilment notes, tracking reference, shipment status, delivery status, returned-parcel information, and exception records.
• Membership analytics and operational events: limited event names and operational metadata used to understand and maintain Membership flows, such as plan, billing interval, entitlement or claim status, feature state, queue depth, and success or failure outcomes. These events are designed not to include card details, passwords, one-time sign-in codes, message contents, delivery addresses, email addresses, or Discord usernames.
• Discord access information: if you request access to an eligible Discord community benefit, the Discord username or handle you provide, your relevant Membership tier or eligibility status, the requested access action, and operational timestamps or notes needed to fulfil and audit the request.

How we use Membership information

• To create, operate, secure, and administer your account.
• To verify your identity, sign you in, maintain sessions, and prevent fraud, spam, automated abuse, and other security threats.
• To operate Membership entitlements and determine whether you may access free or paid features and benefits.
• To create and administer Stripe Checkout Sessions, subscriptions, invoices, renewals, plan changes, cancellations, grace periods, tax calculations, billing-portal access, payment recovery, refunds or corrections where applicable, fraud prevention, reconciliation, and financial or audit records.
• To administer Premium Annual welcome-pack eligibility, claims, stock status, address and size corrections, fulfilment, shipping, tracking, returns, replacements, exceptions, and related support.
• To generate privacy-scrubbed Membership analytics and operational events used to measure feature use, diagnose failures, monitor queues, improve reliability, and understand conversion, entitlement, notification, CoTM, Discord, and merchandise workflows.
• To send transactional, operational, moderation, billing-related, and security messages reasonably necessary to operate your account. Account email is delivered through Amazon SES and is separate from optional marketing email.
• To help you recognise sign-in activity by showing an approximate location on your sessions list and in security emails.
• If you opt in, to add your verified email address to the TweakTown daily newsletter. Where the Membership registration flow expressly states this, verification of your Membership email also verifies the corresponding newsletter request, so a separate verification message is not required for that flow. You may unsubscribe at any time.
• To operate Membership and community features, including public comments, replies, reactions, @mentions, reputation, badges, notifications, saved articles, giveaways, public profile pages, and custom titles. This may include displaying your public display name, approved avatar, badge, or custom title with your public participation.
• To review, moderate, investigate, restrict, remove, or preserve community activity where reasonably necessary to enforce the Terms and Community Guidelines, protect users and systems, comply with legal obligations, or resolve disputes.
• To process optional Discord access requests for eligible members as described below.

Community participation data

When you use community features, TweakTown may process:

• Comments and replies: the text you submit, timestamps, editing or moderation history, and the article or page context.
• Reactions and mentions: your interactions with another member’s content or profile.
• Reputation, badges, and titles: scores, status indicators, Membership badges, or approved titles associated with your account.
• Notifications: notification preferences and delivery or read-status metadata for in-site or email alerts.
• Saved content: articles or pages saved to your account.
• Giveaways: entry, eligibility, consent, draw, verification, and fulfilment records linked to your Membership account.
• Public profile: information displayed on your public member profile and your public participation history.

Legal bases where applicable

• Performance of a contract: to create and operate your account and provide the features or benefits you request.
• Legitimate interests: to secure the service, prevent abuse, moderate the community, maintain audit records, improve operations, and protect TweakTown, its members, staff, and partners.
• Consent: for optional newsletter subscriptions, prize-partner marketing disclosure, optional preferences, and other processing where consent is requested.
• Legal obligations and claims: where processing or retention is reasonably required to comply with law, respond to lawful requests, maintain records, or establish, exercise, or defend legal rights.

Paid Membership billing

Paid Membership checkout, payment processing, tax calculation, subscription administration, payment-method management, invoices, and the customer billing portal are provided through Stripe. Stripe may collect billing contact information, card or other payment details, tax information, device or fraud-prevention information, and transaction data under Stripe’s own privacy policy.

TweakTown does not store your full card number or card security code. TweakTown stores or receives the Stripe and billing identifiers, payment status, amount, currency, tax, subscription, invoice, renewal, cancellation, grace, refund, dispute, and reconciliation information reasonably required to operate paid Membership, provide support, maintain records, prevent fraud, and comply with legal, tax, accounting, and audit obligations.

Premium Annual welcome-pack fulfilment

If you are eligible for and claim a Premium Annual welcome pack, TweakTown collects the information required to process and deliver the claim, including the recipient name, delivery address, telephone number, country, T-shirt size, claim and correction timestamps, and fulfilment or exception information.

TweakTown may provide the information reasonably required for fulfilment to Australia Post, another carrier, a warehouse, merchandise supplier, or another fulfilment provider. Those providers may process the information in Australia or another country involved in preparing, transporting, clearing, tracking, or delivering the parcel.

Claim details may be retained while the claim is open and for as long as reasonably necessary to complete delivery, manage returns or replacements, resolve disputes, prevent duplicate claims, maintain financial or audit records, and comply with law. Personal fulfilment details may later be deleted, de-identified, or scrubbed when they are no longer required.

Membership analytics

Where Membership analytics is enabled, TweakTown records limited first-party operational events relating to Membership and community features. These events may record information such as the event type, plan, billing interval, entitlement state, claim state, period status, queue depth, environment, or success and failure outcomes.

Membership analytics is designed to avoid direct identifiers and sensitive payload content. TweakTown does not intentionally include card details, passwords, one-time sign-in codes, email addresses, delivery addresses, Discord usernames, comment text, or private message content in these analytics events.

Discord community access

Eligible members may be offered access to a TweakTown community hosted on Discord. Discord access is optional and is not required to use your TweakTown Membership account.

When you request Discord access, you provide the Discord username or handle needed to identify your Discord account. TweakTown records the access request and confirms whether your Membership is eligible for the relevant Discord role or community area.

TweakTown does not currently use an automated Discord account-linking API for this process. Instead, the information reasonably necessary to perform an add, update, or removal request is sent by operational email to authorised TweakTown staff. A staff member then manually locates the Discord account and adds, changes, or removes the applicable Discord access.

The operational message may include your Discord username, TweakTown member identifier, public display name, relevant Membership tier or eligibility status, and the requested access action. These details are used only to fulfil, verify, troubleshoot, secure, and audit the Discord access request.

Discord access may be removed when your eligibility ends, when you request removal, when your account is deleted, or when access is restricted under the Terms, Community Guidelines, or applicable Discord community rules.

Discord independently processes information associated with your Discord account and your activity on its service under Discord’s own terms and privacy policy. TweakTown does not control Discord’s independent collection, storage, or use of information.

Retention

• Core account and profile information: retained while your account is active and during any applicable deletion-restoration or paid-through access period.
• Active sessions: retained until they expire, are revoked, or are removed through account deletion or a security action.
• Detailed authentication and security events: generally retained for 12 months.
• Account and administrative audit records: generally retained for 24 months.
• Policy, consent, giveaway, eligibility, and transaction-related audit records: retained for as long as reasonably necessary to demonstrate consent or compliance, administer the relevant service, prevent abuse, resolve disputes, and meet legal, tax, accounting, or audit obligations.
• Billing and subscription records: retained for as long as reasonably necessary to administer the subscription, provide support, reconcile payments, manage disputes, prevent fraud, and comply with legal, tax, accounting, financial, and audit obligations.
• Welcome-pack fulfilment records: retained while the claim or shipment is active and for as long as reasonably necessary to manage stock, delivery, returns, replacements, disputes, duplicate-claim prevention, and legal or audit obligations. Personal fulfilment details may later be deleted, de-identified, or scrubbed when no longer required.
• Membership analytics: retained for as long as reasonably necessary for operational measurement, reliability, security, troubleshooting, and service improvement, and may be aggregated or de-identified where appropriate.
• Discord operational records: retained for as long as reasonably necessary to administer access, investigate problems, protect the community, and maintain an appropriate audit record.
• Community contributions: retained while published or otherwise required for moderation, security, legal, or service-integrity purposes. Following final account deletion, historical contributions may remain in anonymised form so discussions and reply threads remain coherent.
• Backups and caches: deleted or overwritten through normal backup and cache rotation. Information in protected backups is not used for ordinary operations and may be retained temporarily for disaster recovery, security, or legal purposes.

When personal information is no longer reasonably required for a permitted purpose, TweakTown takes reasonable steps to delete or de-identify it, subject to lawful retention requirements and technical limitations affecting backups and caches.

Account deletion

When you request deletion of a free Membership account with no continuing paid access, the account generally enters a 14-day restoration period. During that period, you may cancel the deletion request and restore the account.

If your account has continuing paid Membership access, TweakTown may first stop future renewal and retain the account and its entitlements through the applicable paid-through or grace date. Final deletion will be scheduled for no earlier than the later of:

• the end of the 14-day restoration period; and
• the end of the applicable paid-through, entitlement, or grace period.

While paid-account deletion is scheduled, billing and account actions may be restricted to prevent conflicting changes. Cancelling the account-deletion request does not automatically reverse a separately scheduled subscription cancellation or restart future renewal.

After final deletion, TweakTown removes or anonymises identifying Membership information, including your name, display name, verified email, avatar files, authentication identities, and active sessions, except where limited information must be retained for legal, financial, security, fraud-prevention, dispute, or audit purposes.

Historical comments and other community contributions may remain in anonymised form so discussions and reply threads are not broken. Information already disclosed to an independent third party before deletion, such as a prize partner or Discord, is subject to that third party’s own retention and privacy practices.

Legacy comments

If you previously commented through TweakTown’s legacy commenting system, TweakTown may link those comments to your Membership account using a secure match on your normalised email address. This allows your comment history to remain connected to your account.

Linked historical comments may appear under your current display name and avatar unless they have been anonymised. Until linking is offered or completed, legacy comments remain separate from your Membership account.

Third parties involved in Membership and community operations

• Google: OpenID Connect sign-in and optional profile-picture import. TweakTown does not access Gmail, Drive, Contacts, or unrelated Google content.
• Gravatar (Automattic): where you do not already have a profile picture, TweakTown may use a hashed version of your email address—not your plain-text email address—to ask Gravatar for an available profile image and public profile name. Any imported image is downloaded and processed by TweakTown as described above. Gravatar processes the lookup under Automattic’s Privacy Policy.
• Amazon SES: delivery of account, security, moderation, Discord-operation, and other transactional email.
• Cloudflare: content delivery, network security, abuse prevention, and related technical processing, including IP address and approximate city and country information that TweakTown may store with Membership sessions and security records.
• Stripe: payment processing, tax calculation, fraud prevention, subscription administration, invoices, payment-method management, refunds or payment corrections where applicable, and customer billing-portal services.
• Australia Post and other fulfilment or delivery providers: receipt of the recipient, address, telephone, country, tracking, and other information reasonably required to prepare, ship, clear, track, deliver, return, or replace a Premium Annual welcome pack.
• Merchandise suppliers and fulfilment partners: receipt of the minimum information reasonably required to prepare, pack, replace, or resolve an issue with a welcome pack where TweakTown uses an external supplier or fulfilment provider.
• Discord: optional third-party community platform for eligible members. TweakTown staff manually use the Discord username you provide to add, update, or remove applicable access.
• Named giveaway partners: receipt of entrant email addresses for the partner’s own marketing only where the entrant gives the consent displayed for that promotion.
• Prize fulfilment providers: receipt of winner information reasonably required to verify eligibility and deliver a prize.
• InMobi Choice and Publift: privacy-notice display, consent and preference management, communication of privacy choices, and maintenance of associated consent records as described below.

Access, correction, deletion, and complaints

You may review and update available account information and preferences through My Account. You may also contact support@tweaktown.com to:

• request access to personal information TweakTown holds about you;
• request correction of information that is inaccurate, incomplete, or out of date;
• request deletion or de-identification where applicable;
• withdraw an optional consent or object to particular processing where applicable;
• ask how your information has been handled; or
• make a privacy complaint.

TweakTown may need to verify your identity before responding to a privacy request. Some requests may be limited where information must be retained by law, is required for security or dispute purposes, relates to another person, or cannot reasonably be separated from anonymised or aggregated records.

Privacy Choices and Consent Management

TweakTown uses InMobi Choice CMP, formerly Quantcast Choice, administered for us by Publift, to display privacy notices appropriate to a reader’s location, collect and manage privacy choices, communicate those choices to advertising and measurement partners, honour applicable universal opt-out signals, and maintain records demonstrating those choices.

The CMP processes privacy-preference information, including consent and opt-out selections by purpose and vendor, applicable IAB TCF or GPP privacy strings, the date and time of the interaction, and the version of the notice and CMP configuration presented at that time.

The reader’s active preference is stored in cookies or local storage on their device for up to 13 months unless cleared sooner. Associated historical consent records are retained centrally by InMobi for up to 13 months.

Readers may change or withdraw their choices at any time using the “Privacy” control available on the website. A change or withdrawal does not affect processing lawfully undertaken before that change.

Where required under applicable United States state law, supported universal opt-out signals, including Global Privacy Control, are treated as requests to opt out of the sale or sharing of personal information or targeted advertising.
